These terms govern your use of Visitors analytics platform. We've tried to keep them straightforward and fair while covering the legal basics we need to protect both you and us.
These Terms are a contract between you and Visitors Now, LLC ("Visitors", "we", "us").
By creating an account or using our service, you're agreeing to these terms. We'll update them occasionally and let you know about significant changes through email or other channels.
Our DPA and privacy policy are part of these terms and explain how we handle your data from start to finish.
Keep your account secure. It's yours after all. You're responsible for your password and any activity that happens under your account, including actions by team members you've given access to.
We need a valid email address to create your account and send you important updates. Only real people can create accounts, no bots or automated signups.
Please use our service legally and responsibly. Don't break laws or violate others' rights while using Visitors.

Your free trial gives you full access to test our service without a credit card or limits. Once it ends, you'll need to choose a paid plan to continue using Visitors.
We bill monthly or annually in advance through Stripe, our payment processor. If a payment fails, we'll give you a grace period to update your details before pausing your account.
Plans are based on monthly event limits. Occasional traffic spikes won't trigger extra charges, but if exceed your plan by 3 times the limit, we'll pause your account until you upgrade.
You can change your plan anytime from your account settings. Upgrades take effect immediately, while downgrades happen at your next billing cycle.
All payments are final and non-refundable. We don't offer partial refunds for unused time or features.
You are solely responsible for properly canceling your account. An email to cancel your account is not considered cancellation. You can find a simple no-questions-asked cancellation link in your account settings.
If you cancel the service before the end of your current paid up period, your cancellation will take effect at the end of the current billing cycle, and you will not be charged again.
All of your analytics data will be inaccessible from the service after the time you paid for expires. Within 60 days of that, all data will be permanently deleted from our backups. We cannot recover this information once it has been permanently deleted.
You can choose to delete your account and all your analytics data at any time. All your data will be permanently deleted immediately when you delete your Visitors account.
We reserve the right to suspend or terminate your account and refuse any and all current or future use of the service for any reason at any time. Such termination will result in the deactivation or deletion of your account and access to your analytics data.
Verbal, physical, written or other abuse of any service customer, company employee or officer may result in immediate account termination.
We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of the service with or without notice.
Sometimes we change the pricing structure for our products. When we do that, we tend to exempt existing customers from those changes. However, we may choose to change the prices for existing customers. If we do so, we will give at least 30 days notice and will notify you via the email address on record.
Visitors shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the service.
You are solely responsible for any content and other material that you submit, publish, transmit, or display through the service.
We claim no intellectual property rights over the analytics data you provide to the service. All website data remains yours. You own all right, title, and interest to your website data.
By default, our analytics is designed to avoid collecting personal data about your website visitors. If you choose to use features like identify or send personal data through custom event properties, we process that data on your instructions as described in our DPA and privacy policy.
You may provide us with feedback, suggestions, and ideas about the service. You agree that we own all rights to use and incorporate the feedback you provide in any way, including in future enhancements and modifications to the service, without payment or attribution to you.
The look and feel of the service is copyright to Visitors. All rights reserved. "Visitors", the Visitors logo and any other product or service name or slogan displayed on the service are trademarks of the company and may not be copied, imitated or used, in whole or in part, without prior written permission.
We take many measures to protect and secure your data through backups, redundancies, and encryption. When you use our service to measure your website analytics, Visitors will collect information about your visitors.
You entrust us with your site data and we take that trust to heart. You agree that Visitors may process your data as described in our data policy and for no other purpose.
Each party agrees to handle the other party's data in accordance with all applicable laws and privacy and security measures reasonably adequate to preserve data confidentiality and security.
You agree to comply with all applicable laws including all privacy and data protection regulations. For detailed information about your rights and compliance requirements, see our GDPR compliance page.
You agree not to use the service to send sensitive information where unauthorized disclosure could cause material, severe, or catastrophic harm. This includes credit card information, government issued identification numbers, financial account information, and personally identifiable information that could be used to directly identify, contact, or precisely locate an individual.
Your use of Visitors is at your sole risk. The service is provided on an "as is" and "as available" basis. We do take uptime of our application seriously.
We design our services with care, based on our own experience and the experiences of customers who share their time and feedback. However, there is no such thing as a service that pleases everybody. We make no guarantees that our services will meet your specific requirements or expectations.
We test all of our features extensively before shipping them. As with any software, our services inevitably have some bugs. We track bugs reported to us and work through priority ones, especially any related to security or privacy. Not all reported bugs will get fixed and we don't guarantee completely error-free services.
Technical support is provided by email. Email responses are provided on a reasonable effort basis without guaranteed response time.
We as humans can access your data to help you with support requests you make and to maintain and safeguard Visitors to ensure the security of your data and the service as a whole.
We use third party vendors to provide the necessary hardware, storage, payment processing and related technology required to run the service. You can see details about our subprocessors in our privacy policy.
We work hard to provide reliable analytics, but like any software service, things can go wrong. Our service is provided "as is" and we can't guarantee it will always work perfectly or meet every need.
We're not liable for any business losses, lost profits, or indirect damages that might result from using or not being able to use our service. This includes situations like server outages, bugs, or service interruptions.
We invest heavily in security, reliability, and customer support because we want you to succeed. But ultimately, you're choosing to rely on our service for your analytics needs, and that choice comes with some risk.
These Terms are governed by the laws of Western Australia, Australia, without regard to conflict of law rules.
Before starting a formal dispute, you agree to contact us and attempt to resolve the issue informally for 30 days.
If we can't resolve the dispute informally, any dispute arising out of or relating to these Terms or the service will be resolved by binding arbitration seated in Perth, Western Australia. The arbitration will be conducted remotely by video conference unless the parties agree otherwise.
We may update these terms as needed to reflect changes in our service or for legal compliance. When we make significant changes, we'll notify you via email and announce updates through other channels.
